KATHMANDU – A video statement of Constituent Assembly Chairman Subash Chandra Nembang arguing that the Prime Minister cannot dissolve the House of Representatives has entered the Constitutional Bench.
During the hearing on the House dissolution case today at the Constitutional Bench, advocate Dinmani Pokharel said that the statement of Nembang, who is also a NCP leader, should be considered by the bench as evidence against the government’s move to dissolve the House.
“The remark could be used as the evidence. This is not something said by Subash Nembang. This is the remark from the Constituent Assembly’s Chairman,” said advocate Pokharel.
In a short video clip that has gone viral in social media, leader Nembang is heard arguing that the Prime Minister does not have any prerogative to dissolve the House.
The video is said to be a program organized nearly one year ago by Society of Parliamentary Affairs Journalists where he has addressed as a speaker. Nembang is currently with the Nepal Communist Party (NCP) led by Prime Minister KP Sharma Oli.
The statement of Nembang that rules out any possibility of House dissolution before five years of getting elected has now been raised in the Constitutional Bench which is examining whether the Prime Minister Oli’s move is in line with the constitution.
In the video, Nembang says, “ The House cannot get dissolved just because the Prime Minister is angry. The election is held exactly in five years.”
