{"id":4545,"date":"2020-12-23T11:38:26","date_gmt":"2020-12-23T05:53:26","guid":{"rendered":"https:\/\/english.kathmandupati.com\/?p=4545"},"modified":"2020-12-23T11:38:26","modified_gmt":"2020-12-23T05:53:26","slug":"writs-challenging-govts-move-to-dissolve-parliament-assigned-to-chief-justice-ranas-single-bench","status":"publish","type":"post","link":"https:\/\/english.kathmandupati.com\/?p=4545","title":{"rendered":"Writs challenging govt\u2019s move to dissolve parliament assigned to Chief Justice Rana\u2019s single bench\u00a0"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Kathmandu-<\/span>A dozen of writs challenging the government\u2019s decision to dissolve the House of Representatives have been scheduled for the hearing at the Supreme Court for today.<\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The Supreme Court has assigned all those 12 writs filed against the dissolution of the parliament to the single bench led by Chief Justice Cholendra Shumsher JB Rana.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The hearing on the case is currently underway at the single bench led by Chief Justice Rana.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Earlier on Sunday, nearly half a dozen lawyers had moved to the apex court demanding the annulment of the government decision to dissolve the parliament and set dates for midterm election.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Senior advocates Dinesh Tripathi, Kanchan Krishna Neupane and Lokendra Bahadur Oli had filed the writ petition immediately after the President Bidya Devi Bhandari, upon the government\u2019s recommendation, dissolved the HoR and set the new date for midterm election on Sunday.\u00a0\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Similarly, the ruling Nepal Communist Party\u2019s Chief Whip Dev Bahadur Gurung had also filed the writ seeking the court\u2019s intervention to overturn the government\u2019s decision.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The petitioners have argued that the government does not have a constitutional and legal right to dissolve the HoR.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\">\n","protected":false},"excerpt":{"rendered":"<p>Kathmandu-A dozen of writs challenging the government\u2019s decision to dissolve the House of Representatives have been scheduled for the hearing at the Supreme Court for today.
