{"id":5249,"date":"2021-01-17T15:33:51","date_gmt":"2021-01-17T09:48:51","guid":{"rendered":"https:\/\/english.kathmandupati.com\/?p=5249"},"modified":"2021-01-17T15:33:51","modified_gmt":"2021-01-17T09:48:51","slug":"petitioners-urge-constitutional-bench-to-seek-records-of-discussions-at-constitution-assembly","status":"publish","type":"post","link":"https:\/\/english.kathmandupati.com\/?p=5249","title":{"rendered":"Petitioners urge Constitutional Bench to seek records of discussions at Constitution Assembly"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>KATHMANDU &#8211;<\/strong> Petitioners of the writ petitions challenging the government move to dissolve the House of Representatives have demanded the Supreme Court to order the government to furnish record of discussions held at the Constitution Assembly while drafting the constitution.<\/p>\n<p style=\"text-align: justify;\">During the hearing held on Sunday at the Constitutional Bench, Senior Advocate Dinesh Tripathi argued that the apex court should order the government to present records and documents of the discussion held in the Constitution Assembly during the constitution drafting process.<\/p>\n<p style=\"text-align: justify;\">\u201cWhat discussions were held in terms of provision to dissolve the House? The record of the discussion in the Constitution Assembly should be brought,\u201d said Tripathi. Similarly, another petitioner Santosh Bhandari argued that the verdict of the Supreme Court should be based on the constitution.<\/p>\n<p style=\"text-align: justify;\">Stating that there is no trust that the midterm election will be held by the government which has failed to provide free treatment to the people suffering from Covid-19, he said that the election is held in five years is clearly stipulated in the constitution.<\/p>\n<p style=\"text-align: justify;\">Chief Justice Cholendra Shumsher JB Rana also said that he was ready to ask for records of discussions in the Constitution Assembly if needed.<\/p>\n<p style=\"text-align: justify;\">The five-member Constitutional Bench is conducting hearings to examine whether the government\u2019s decision to dissolve the House of Representatives and set dates for midterm election is in line with the constitution.
