गृहपृष्ठ ∕ Politics ∕ Constitutional bench formed to conduct hearing on HoR dissolution Politics Constitutional bench formed to conduct hearing on HoR dissolution KathmanduPati June 06, 2021 KATHMANDU – Chief Justice Cholendra Shumsher JB Rana has formed a constitutional bench on the basis of seniority to conduct hearing on the dissolution of House of Representatives (HoR). The constitutional bench now comprises CJ Rana, and senior justices Dipak Kumar Karki, Mira Khadka, Ishwor Prasad Khatiwada and Dr Anand Mohan Bhattarai. Although justice Hari Krishna Karki is third in seniority among the SC judges, he is not included in the bench as his presence in the bench was questioned earlier. CJ Rana had made agreement with Nepal Bar Association to form the constitutional bench based on seniority. The constitutional bench was formed again based on seniority after the dispute surfaced on the case relating to HoR dissolution. CJ Rana has scheduled hearing on it today. In case of the need of substantial constitutional interpretation of the case sub judice in Supreme Court, there is a provision that CJ assigns justices in the constitutional bench to settle the case. The constitution has given authority to the SC to conduct such bench. The hearing on the HoR dissolution is being held today. Thirty writ petitions were filed at SC regarding this.
